RAMZAN KADYROV VS HRC MEMORIAL AND OLEG ORLOV
LIBEL TRIAL AND CRIMINAL CASE
Criminal case ¹310555 in accordance with part 3, art.129 (libel) of the Criminal Code of Russia against Chairman of the Board of HRC «Memorial» Oleg Orlov, was initiated on October 20, 2009.
The proceeding was initiated in relation with the fact that on July 15, 2009 in a Memorial declaration « About the murder of Natalia Estemirova » Oleg Orlov made the President of Chechen Republic Ramzan Kadyrov responsible for the murder of HRC «Memorial» 's employee in Caucasus Natalia Estemirova.
On July 6, 2010 accusations were presented against Orlov.
On September 13 at the circuit court ¹363 of the Khamovniki district of Moscow the first court session chaired by magistrate Karina Morozova took place.
Lawyer Henry Reznik defended O. Orlov. The lawyer of the victim R. Kadyrov was Andrei Krasnenkov.
At the final court session on June 14, 2011, the judge Karina Morozova passed an absolutely sentence for Oleg Orlov.
The public prosecutor Artem Sadovnikov lodged an appeal on June 22 (in Russian), the representative of the victim sent a petition of appeal to the court on June 24 (in Russian). Orlov's lawyer lodged his objections in July (in Russian).
On October 4, 2011 in Khamovniki ñourt the consideration of appeals started. In the course of the three hearings the judge Andrey Lutov would read out the witnesses’ testimonies. Kadyrov’s representative intended to summon new witnesses and launch a mysterious media campaign. At the same time, President Medvedev implemented a law that decriminalized libel, and on January 20, 2012 the ‘not guilty’ verdict by the court of the first instance was repealed and the case against Orlov was discontinued.

Criminal case ¹310555 in accordance with part 3, art.129 (libel) of the Criminal Code of Russia against Chairman of the Board of HRC «Memorial» Oleg Orlov, was initiated on October 20, 2009. The proceeding was initiated in relation with the fact that on July 15, 2009 in a Memorial declaration « About the murder of Natalia Estemirova » Oleg Orlov made the President of Chechen Republic Ramzan Kadyrov responsible for the murder of HRC «Memorial» 's employee in Caucasus Natalia Estemirova. On July 6, 2010 accusations were presented against Orlov. On September 13 at the circuit court ¹363 of the Khamovniki district of Moscow (Street year 1905, house 4, building 1) the first court session chaired by magistrate Karina Morozova took place. Lawyer Henry Reznik stands for the defense of O. Orlov. The lawyer of the victim R. Kadyrov is Andrei Krasnenkov. In the course of seven court sessions seven witnesses for the prosecution were interrogated: Malsagova A., Dzubajraev O., Djumaliev U., Kagirova T., Komkov S., Nuhajiev N., Dadalaev I.; and seven defense witnesses : Gannushkina S., Cherkasov A., Sokirianskaya E., Lokshina T., Shvedov G., Kalyapin I., Mnacakanyan A. Further two «technical» witnesses were interrogated - Orlov I. and Klimova Y. - and written testimonies from the prosecution side were examined. At the hearing on May 16, 2011 the investigation in court was brought to an end. The witnesses Muslim Khuchiev, Al'vy Karimov, Salavdi Dzhamiev, Zoya Svetova and Svetlana Gannushkina (repeated interrogation) were questioned. On June 9, 2011, at another court hearing pleadings took place. Senior assistant prosecutor Artem Sadovnikov asked the trial to find Orlov guilty and inflict penalty of 150 000 roubles. At the final court session on June 14, 2011, the judge Karina Morozova passed an absolutely sentence for Oleg Orlov.
