Consideration of Orlov's case has Started in the Court of Second Instance

Yesterday on October 4, in Khamovniki сourt the consideration of appeals on acquittal of the head of the Human Rights Center "Memorial" Oleg Orlov charged with libel against the President of Chechnya Ramzan Kadyrov started. The presiding judge was Andrey Lutov.

The hearing started with the two motions from the representative of the victim – Andrey Krasnenkov. He demanded to send requests to the Transport department of the Ministry of Interior of the Russian Federation of the Central district. According to Krasnenkov it was necessary to get the information about Orlov's travelling in August 2011 because he supposedly violated the recognizance not to leave when he left Moscow for vacation (indeed this sanction wasn't imposed). Also Krasnenkov found it necessary to get the information about Natalya Estemirova's daughter and Natalya's travelling since 2008 till her talk with Ramzan Kadyrov and her death. According to this information he tried to prove that Estemirova travelled easily and didn't hide abroad due to the security. The judge rejected these motions.

After that the judge turned to the trial investigation. Appeals of the public prosecutor Artem Sadovnikov (http://www.memo.ru/2011/09/27/ap.pdf in Russian) and Andrey Krasnenkov (http://www.memo.ru/2011/09/27/az.pdf in Russian) were read along with the objections of Genry Reznik, Orlov's lawyer (http://www.memo.ru/2011/09/27/2709111.html in Russian).

Then the lawyer Reznik suggested interrogating not all the witnesses but several of them under party's choice in order not to drag out the trial. The lawyer made a motion to interrogate HRC "Memorial" employees Ekaterina Sokiryanskaya (see her interrogation in the court of first instance http://www.memo.ru/2011/01/11/1101111.html#__RefHeading__239_1277371114), Aleksandr Cherkasov (http://www.memo.ru/2010/12/14/1412101.htm#_Toc280125499) and employee of the "Human Rights Watch" Moscow office Tatyana Lokshina (http://www.memo.ru/2011/01/11/1101111.html#__RefHeading__237_1277371114). Krasnenkov made a motion to interrogate the mayor of Grozny Muslim Khuchiev (http://www.memo.ru/2011/06/08/0806111.html#__RefHeading__353_1999748555) due to the fact that he wasn't properly interrogated about the last meeting of Estemirova and Kadyrov where he was present and Grigory Shvedov (http://www.memo.ru/2011/02/02/0202111.html#__RefHeading__245_1256926638), Internet-source "Caucasian Knot" editor in-chief. Krasnenkov said that he would probably make a motion on the interrogation of other witnesses. The judge agreed with the proposals and started announcing witnesses' testimony.

Next court hearings will happen on October 24 and 28 at 11 am. If the mentioned witnesses come they will be interrogated if not, their testimony from previous interrogations will be read.
